Notice of Non-Discrimination & Title IX

Under the Federal Title VII Act:

Moriarty-Edgewood School District does not discriminate on the basis of race, color, national origin, gender identity, sexual orientation, HIV status, marital status, pregnancy, sex, disability, or age in its hiring practices, educational programs or activities.

El Distrito Escolar de Moriarty-Edgewood no discrimina por motivos de raza, color, origen nacional, identidad de género, orientación sexual, estado de VIH, estado civil, embarazo, sexo, discapacidad o edad en sus prácticas de contratación. , programas o actividades educativas.

Under the Federal Title IX Act:

No person in the United States shall, on the basis of sex, be excuded from participation in, be denied the benefits of, or be subjected to discrimination under any educational program or activity recieving Federal financial assistance.

Reporting Complaint of Discrimination or Sexual Harassment

Per Moriarty-Edgewood School District Policy AC and Policy ACA, the District has the following methods to report incidents of discrimination or sexual harassment:

1. Any student or staff employee who believes he/she has been the target of discriminatory or harassing conduct by another student or by a school employee, or any person with knowledge or belief of such conduct toward a student should immediately report the alleged acts to a teacher, counselor, principal, other District employee, or the appropriate District Title IX Coordinator.  

The report must be filed within thirty (30) calendar days after the complaining party knew or should have known that there were grounds for a complaint. 

2. Any District employee who suspects or receives notice that a student or group of students has or may have experienced prohibited conduct shall immediately notify the campus principal or the appropriate District official listed in Policies AC and ACA.

3. Reports should be done in writing using the District .  A copy of this form must be submitted to the appropriate school official or district official.  

4. The Complainant is not required to report discriminatory or harassing conduct to the Respondent alleged to have committed the conduct. Reports concerning such prohibited conduct may be directed to the Title IX Coordinator.  A report against the Superintendent may be made directly to the Board. If a report is made directly to the Board, the Board shall appoint an appropriate person to conduct an investigation. 

 

Investigating Discriminatory or Harassing Conduct 

Per Moriarty-Edgwood School District Board Policy Policies AC and ACA, the district will appropriately and promptly investigate all reports of discrimination. School principal or designee must accept and investigate all reports of discrimination and harassment.

 

Investigation Time Frame

Per Moriarty-Edgewood School District Board Policies AC and ACA, the investigation will be completed within twenty (20) school days, and if the investigation requires more time, the administrator (or investigator) will inform the parties involved. The Title IX Coordinator shall make a written report to the Superintendent upon completion of the investigation. If the complaint involves an alleged misconduct by certified personnel, any necessary reports shall be filed with the NMPED, Educator Ethics Bureau. The report shall include a determination of whether the allegations have been substantiated as factual, whether they appear to be violations of this policy, any supportive measure provided and any informal/formal resolutions. 

A copy of the completed report will be maintained by the MESD Personnel Department.

Retaliation and Confidentiality

Per Moriarty-Edgwood School District Board Policies AC and ACA, the District prohibits retaliation by a student or District employee against a student or district employee alleged to have experienced discrimination or harassment, or a student or district employee who, in good faith, makes a report of harassment or discrimination, serves as a witness, or participates in an investigation. The right to confidentiality, both of the complainant and the accused, shall be preserved consistent with applicable laws.

False Complaints or Claims

Per Moriarty-Edgwood School District Board Policies AC and ACA, a student or district employee who intentionally makes a false claim or offers false statements regarding complaints of discrimination or harassment shall be subject to appropriate disciplinary action.
